1. About these terms
This website is operated by VALVD, trading as VALVD. By accessing this site or placing an order you agree to these terms. If you do not agree, do not use the site.
These terms should be read together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy and Legal Notice.
2. Eligibility
You must be at least 18 years old and legally able to enter a contract to place an order. By ordering you confirm that you are.
3. Products, descriptions and availability
We make every effort to display our products, specifications and fitment information accurately. Colours, finishes and sound recordings may appear differently depending on your device, vehicle and conditions, and are not a guarantee of exact appearance or result.
Products are subject to availability. We may change, limit or discontinue any product at any time without notice, and we may limit quantities per customer or per order.
4. Orders and acceptance
Your order is an offer to purchase. Our order confirmation email acknowledges receipt but does not constitute acceptance. A contract is formed only when we dispatch your order.
We may refuse or cancel any order at our discretion, including where the product is unavailable, where there is an error in the price or product description, where we suspect fraud, or where an order appears to be placed for resale without authorisation. If we cancel an order you have paid for, we will refund you in full.
5. Pricing and errors
Prices are in Australian dollars and include GST where applicable. Prices may change at any time before you place an order.
Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. Where an error is obvious and could reasonably have been recognised by you as an error, we may cancel the order and refund you in full, even after the order has been confirmed.
6. Payment
Payment is required in full at the time of ordering. By providing payment details you confirm you are authorised to use the payment method. We do not store your full card details; payments are handled by our payment providers.
7. Shipping and returns
Shipping is covered in our Shipping Policy. Returns, refunds and our fitment guarantee are covered in our Returns & Refunds Policy. Both form part of these terms.
8. Fitment
Fitment information is based on our own testing of factory actuator connectors and is provided in good faith. Vehicles vary by market, build date, specification and prior modification.
You are responsible for confirming your vehicle's exhaust configuration before ordering. Where you are unsure, contact us before purchase.
9. Product use and your responsibilities
Our products are supplied for off-road and show use. Exhaust noise is regulated and requirements vary by state, territory and country. You are responsible for knowing and complying with the law where you drive.
Installation is undertaken at your own risk and should only be attempted with appropriate equipment. If you are not confident, use a qualified workshop.
We are not liable for fines, defect notices, failed inspections, warranty disputes with your vehicle manufacturer, or any loss arising from incorrect installation or use of the product other than as described in our instructions.
10. Intellectual property
All content on this site, including text, images, video, graphics and the VALVD name and logo, is owned by BUSINESS_NAME or licensed to us and is protected by copyright and trade mark law. You may not reproduce, distribute or use it commercially without our written permission.
Vehicle manufacturer names and model designations are used for fitment identification only. See our Legal Notice.
11. Acceptable use
You must not use this site for any unlawful purpose, attempt to gain unauthorised access to it, interfere with its operation, scrape or harvest its content, or submit false information. We may refuse service or terminate access for breach of these terms.
12. Reviews and submissions
If you submit a review, photo, comment or other content, you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce and publish it in connection with our business. You confirm the content is yours to give and does not infringe anyone's rights. We may edit or remove submissions at our discretion.
13. Third party links and services
This site may link to or integrate third party sites and services. We do not control them and are not responsible for their content, products, terms or practices.
14. Disclaimer and limitation of liability
To the extent permitted by law, the site and its content are provided on an "as is" basis without warranties of any kind, and our liability for any claim arising in connection with our products or this site is limited, at our option, to replacing the product or refunding the price you paid for it.
We are not liable for indirect or consequential loss, including loss of profits, loss of use of a vehicle, towing, workshop labour, or costs of removal or reinstallation.
15. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies the consumer guarantees under the Australian Consumer Law or any other right or remedy that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
16. Indemnity
You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of our products, or your use of our products in a manner contrary to law.
17. Changes to these terms
We may update these terms at any time. The version published on this page at the time you place an order is the version that applies to that order.
18. Severability and governing law
If any provision of these terms is found to be unenforceable, the remaining provisions continue in force. These terms are governed by the laws of Queensland, Australia, and you submit to the jurisdiction of the courts of that state.
